The applied-for-trademark consists of “OneClick” in standard characters.

Even though the English word “OneClick” means “pressing a mouse button once on a computer,” it is difficult to say that “OneClick” would be recognized and understood directly as an indication of a specific quality of goods in connection with the designated goods.

The Appeal Examiners did not find any facts that “OneClick” and the corresponding term “OneClick in katakana” have been commonly used to indicate a quality of goods, etc. in the field of the designated goods through ex-officio searches. Further, they did not find any circumstances in which traders and consumers could not recognize “OneClick” as a distinguishing mark in the field of the designated goods.

With the above in mind, it is difficult to say that the applied-for-trademark consists solely of a mark indicating the quality of goods in a common manner. The applied-for-trademark can serve as a distinguishing mark.

Thus, the applied-for-trademark should be registered.

The applicant recited the following earlier-registered trademark and argued that the applied-for-trademark should be registered to maintain consistent examination of applications:

– JP Reg. No. 4250956 “DOUBLECLICK and DOUBLECLICK in katakana” (Designated goods: electronic machines, apparatus and their parts; and others, in Class 9; etc.)
